General Sales Conditions (GSC) and General Terms of Use (GTU)

Art.1 – Introduction

Every transaction electronically conducted with our company on the OKAZIONEL website is subject to these general sales conditions. These conditions exclusively govern the sale of products offered on the OKAZIONEL website. They are always accessible on this site for the customer at the time of validating the order. Therefore, placing an order implies the customer's full and unconditional acceptance of these general sales conditions, excluding all other conditions mentioned in brochures, catalogs by the seller, and especially those in force in the OKAZIONEL stores. They can be consulted in French. They can be printed by following the instructions on the customer's internet browser. For additional information, the customer can contact the e-boutique customer service via the form available here. The OKAZIONEL website is reserved for consumers. The purchase of product(s) by a professional for resale is prohibited. We strive to ensure the accuracy and updating of the information on this site as much as possible, and we reserve the right to correct the content at any time and without notice. If a condition is missing, it is considered to be governed by the practices and laws in force in Belgium in the field of distance selling.

Art.3 – Information to the consumer

In addition, the customer has received the sales conditions relating to the consumer code, before and after the closing of the sale and in particular through these general sales conditions of which he declares to have taken knowledge before validating his order and to which he has access from the OKAZIONEL website. The photos of the items for sale on the OKAZIONEL website have no contractual value and can vary slightly from the items themselves.

Art.4 – Order

To place an order on our site, you must be of legal age, have legal capacity, and use this site in accordance with our general sales conditions. The steps to place an order are as follows:

  • Selection of products and addition to the cart
  • Validation of the content of the cart
  • Identification on the site if the customer is not yet identified
  • Choice of delivery method
  • Acceptance of the general sales conditions
  • Choice of payment method and acceptance of the general sales conditions
  • Validation of payment The customer will receive an email confirming the order. He can view the detail of his order and its total price during these different steps and correct any errors before confirming it to express his acceptance. OKAZIONEL reserves the right not to record a payment, and not to confirm an order for any reason whatsoever, in particular in case of supply problem, or in case of difficulty concerning the order received.

Art.5 – Prices

The prices of our products are indicated in euros, all taxes included, excluding processing and shipping costs. All orders, regardless of their origin, are payable in euros. OKAZIONEL reserves the right to modify its prices at any time, but the products will be invoiced based on the rates in effect at the time of the registration of the orders, subject to availability. The products remain the property of OKAZIONEL until full payment of the price.

Art.6 – Payment

The payment of your purchases is made by bank card. Cards issued by banks domiciled outside Belgium must be international bank cards. The payment is charged immediately after the order. The entered amount is reserved on your card at the time of the order. The amount is actually debited from your card at the time of the physical registration of the order.

Art.7 – Delivery

The products are delivered to the delivery address that you indicated during the ordering process, within the time indicated on the page of the validated order. In case of absence, a passage notice is left at the delivery address indicated by the customer, allowing the customer to pick up the package at a later date and at an indicated place.

 

Art.8 - Return Policy

 

In accordance with consumer law, the customer has a reflection period of fourteen clear days from receipt to cancel their order without having to justify reasons, except for the return costs which remain at their expense. Returns are accepted provided that the original packaging is in new, unopened condition, and that the items, especially lingerie, have never been worn. This requirement also applies to sex toys and accessories. To initiate the return process, a written request must be sent to commercial@okazionel.com.

 

Following our assessment, a confirmation email containing the address of our depot and the reference for the return will be sent to the customer.

 

Items must be returned in their original packaging, complete, labeled, new, unworn, unused, unwashed, uncreased, and accompanied by the return confirmation email. Items that do not meet these conditions, or that are damaged, deteriorated, or soiled by the customer, will not be refunded. Returns not accompanied by the return confirmation email from our services will not be processed, and the products will be destroyed or returned at your expense.

 

The costs and risks of return are the responsibility of the customer. We strongly recommend sending the package by a secure method that provides proof of dispatch and a definite date. Once the returned items are received, checked, and accepted by our services, the refund will be made by crediting the customer's bank account within a maximum period of 30 days.

 

Art.9 - Condition of Products and Management of Returned Parcels

 

Receipt of the order: It is imperative for the customer to check the condition of the products upon receipt. In the case of a damaged product, the customer must notify us by email with photos: commercial@okazionel.com, within three days of delivery, of any reservations or anomalies observed.

 

If the delivered product does not match the order (wrong product, color, size, etc.), the customer must inform OKAZIONEL by email within three days following delivery. The product must be returned to OKAZIONEL within fourteen days following delivery. The return costs will be converted into a voucher.

 

Parcel returned by the carrier: If a parcel is returned to us due to "Incorrect address", "Not claimed" or "Parcel refused", our customer service will contact the recipient to inform them of the situation. Confirmation of the delivery address will be requested for a possible reshipment of the parcel, with possible participation in the shipping costs. Without a response within two weeks, the parcel and any potential refund will be put on hold.

Art.10 – Responsibility

The offered products comply with Belgian legislation and standards applicable in Belgium. The photos are for illustrative purposes. We invite you to refer to the description of each product to know its precise characteristics; and in case of doubt or if you wish additional information, you can contact us via the form available here. OKAZIONEL is not responsible for indirect damages resulting from the purchase of the products. OKAZIONEL cannot be held responsible for the loss of data, files. It is up to the customer to make all necessary backups. The total or partial impossibility to use the products, particularly due to equipment incompatibility, cannot give rise to any compensation, reimbursement or the responsibility of OKAZIONEL, except in the case of a hidden defect, non-compliance, defect or exercise of the right of withdrawal.

Art.11 – Liability

OKAZIONEL cannot be held responsible for the non-execution of the contract concluded in the event of stock shortage or unavailability of the product, force majeure, disturbance or total or partial strike, particularly of postal services and means of transport and/or communications, flood, fire.

OKAZIONEL will incur no liability for any indirect damages due to these, operating loss, loss of profit, loss of opportunity, damages or expenses.

Hypertext links may refer to other sites than the site www.okazionel.com. OKAZIONEL disclaims all liability in the event that the content of these sites contravenes the legal and regulatory provisions in force.

Furthermore, OKAZIONEL reminds that any creation of a hypertext link to the homepage of this Site or any other page of the Site is subject to the express, prior and written agreement of OKAZIONEL.

Art.12 – Intellectual Property

All elements of the site www.okazionel.com, whether visual or auditory, including the underlying technology, are protected by copyright, trademarks or patents.

They are the exclusive property of OKAZIONEL. Any user who has a personal website and wishes to place, for personal use, on his site a simple link directly leading to the homepage of the site www.okazionel.com, must necessarily ask for permission to OKAZIONEL. In any case, any link, even tacitly authorized, must be removed upon simple request of OKAZIONEL.

Art.13 – Personal Data

OKAZIONEL, for the needs of the service, reserves the right to collect nominative data relating to the users of the site, in particular by means of "cookie". All users have the right to access, rectify, complete, update, lock, unlock or delete the personal data concerning him by writing to the email address of OKAZIONEL: commercial@okazionel.com.

Art.14 – Entirety

In the event that one of the clauses of this contract would be null and void by a change in legislation, regulation or by a court decision, this would in no way affect the validity and respect of the other provisions of these general conditions of sale.

Art.15 – Duration

These conditions apply throughout the duration of the online services offered by OKAZIONEL.

Art.16 – Proof

The computerized registers, kept in the computer systems of OKAZIONEL and its partners under reasonable conditions of security, will be considered as the proofs of communications, orders and payments occurred between the parties.

Art.17 – Conservation and Archiving of Transactions

The archiving of purchase orders and invoices is carried out on a reliable and durable medium that can be produced as evidence.
